Terms of Use

This document is complete and names its owner and contact, but it has not been through a legal review yet.

These Terms of Use govern your use of Lexmem ("the App"), published by Ruslan Alimbetov ("the Developer"), an individual trading under the exordix brand. Installing or using the App means you accept them.

# This agreement is with the Developer, not Apple

These Terms are concluded between you and the Developer alone. Apple is not a party to them and is not responsible for the App or its content.

# Licence

The Developer grants you a personal, non-transferable, non-exclusive licence to use the App on any Apple-branded product that you own or control, as permitted by the Usage Rules in the App Store Terms of Service. You may not redistribute the App, rent or sublicense it, or attempt to extract its source code except where law allows it regardless of this restriction.

# What the App does

Lexmem saves words and phrases you capture from other apps and brings them back on a spaced repetition schedule. Without a subscription it works entirely on your iPhone, translating with Apple's on-device translation.

Lexmem Plus is an optional subscription. It adds a breakdown of a saved word produced by a third-party language model, and it translates the language pairs your iPhone has no on-device language pack for. Its output is generated automatically, may be wrong or incomplete, and is not a certified translation, professional advice, or a substitute for a dictionary. Lexmem is not a licensed educational service and promises no particular learning result.

# Subscription and payment

Lexmem Plus is an auto-renewing subscription billed by Apple through your App Store account. The price, period and any introductory offer are shown in the App before you buy and in the App Store.

The subscription renews automatically unless you turn renewal off at least 24 hours before the current period ends. Manage or cancel it in the Settings app of your iPhone, under your Apple Account; the Developer cannot cancel it for you. Refunds are handled by Apple under its own rules.

Fair-use limits apply to the number of breakdowns per day, so that one account cannot exhaust the service for everyone.

# Your content and acceptable use

The words, phrases and context you save remain yours. By using Lexmem Plus you instruct the Developer to transmit that text for processing as described in the Privacy Policy — do not send text you are not free to share.

You agree not to use the App unlawfully, not to attempt to break, probe or overload the service, and not to use it to generate unlawful material.

# Availability

The App and the Lexmem Plus service are provided as they are. The Developer does not guarantee uninterrupted availability and may change or discontinue features. If the service is discontinued, an active subscription will be cancelled and you may seek a refund from Apple for any unused period.

# Maintenance and support

The Developer alone is responsible for support and maintenance of the App. Apple has no obligation whatsoever to furnish any maintenance or support services for it. Contact details are on the Support page.

# Warranty

The Developer alone is responsible for any warranty, express or implied, to the extent it is not effectively disclaimed. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.

# Claims

The Developer, not Apple, is responsible for addressing any claim relating to the App or your use of it, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation. The Developer, not Apple, is responsible for the investigation, defence, settlement and discharge of any third-party claim that the App or your use of it infringes that party's intellectual property rights.

# Apple as third-party beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of them Apple has the right — and is deemed to have accepted the right — to enforce these Terms against you as a third-party beneficiary.

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

# Termination

You may stop using the App at any time and delete it. The Developer may suspend access to the Lexmem Plus service where it is used in breach of these Terms or to protect the service, and will tell you why at the contact address you used, if any.

# Changes

These Terms may be updated. The current version is always at this address, with its effective date shown above, and earlier revisions stay reachable from the list at the foot of this page.

# Governing law and contact

These Terms are governed by the law of the Republic of Kazakhstan, without prejudice to mandatory consumer protections in your country of residence. Questions: Ruslan Alimbetov, appteam@exordix.com.
